D. Todd Smith has a statewide practice focusing on civil appellate matters and related legal issues before Texas courts.  He represents plaintiffs and defendants in all phases of civil appeals and original proceedings, including preparation of written briefs and presentation of oral argument.  A significant part of Todd’s practice takes place at the trial-court level, where he serves as a consultant to other lawyers and their clients or as additional counsel of record.  When engaged in a litigation support role, Todd assists trial counsel with strategic analysis and briefing, jury charges, and potentially dispositive motions, all with a focus on preserving error and positioning cases for appellate review.

Todd’s recent engagements have involved commercial disputes (breach of contract, breach of warranty, fraud, and deceptive trade practices), court-imposed sanctions, real estate disputes, personal injuries, and legal malpractice.  These issues have arisen in the context of default judgments, summary judgments, bench trials, and jury trials involving significant monetary awards.  Todd also handles arbitration-related litigation in state and federal courts.

Although Todd is based in Austin, he leverages technology to break down any perceived geographic barriers and frequently handles matters in other parts of the state.  As an independent practitioner, he has developed a network of professionals capable of staffing even the largest cases, and he puts his big firm experience to work for a variety of clients using a compensation structure tailored to their particular needs.  Todd is often able to handle a case through a specified stage for a flat fee, bringing certainty and predictability to the client’s legal expenses.  Contingent and reverse-contingent fee arrangements are considered on a case-by-case basis.
